WHEELING, W.Va. (AP) — More than 500 southern West Virginian residents who claim Massey Energy poisoned their wells and ruined their health with coal slurry will get their day in court next year — and a chance to settle this fall.
A mass litigation panel handling the case against Massey and subsidiary Rawl Sales & Processing set an Aug. 1, 2011 trial in Wheeling on Friday.
Judge Alan Moats warned dozens of lawyers involved in the case to clear their schedules for two months.
Two judges will oversee mediation of a possible settlement on Nov. 15 in Charleston. Three other judges will prepare for the trial.
Virginia-based Massey denies wrongdoing.
